Terms of Service

Welcome to EventMatch. These Terms of Service ("Terms") govern your access to and use of the EventMatch mobile application and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Definitions

EventMatch / Service

The mobile application and platform operated by EventMatch that facilitates staffing services.

User / You

Any individual or entity that accesses or uses the Service, including Staff and Agencies.

Staff

Hospitality professionals who register on the platform to find and accept shift work opportunities.

Agency

Staffing agencies that use the platform to manage shifts, assign staff, and coordinate event staffing.

Shift

A work assignment posted by an Agency, including details such as location, time, and compensation.

Content

Any information, text, graphics, photos, or other materials uploaded, posted, or transmitted through the Service.

2. Eligibility

To use the Service, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable laws
Provide accurate, current, and complete information during registration
If registering as an Agency, have the authority to bind your organization to these Terms

3. Account Registration & Security

3.1 Account Creation

You must create an account to access most features of the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
We are not liable for any loss or damage arising from unauthorized account access

3.3 Account Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

4. Service Description

EventMatch is a platform that connects hospitality professionals with staffing agencies for event-based work. The Service includes:

For Staff

  • •Create and maintain professional profiles
  • •Browse and accept shift opportunities
  • •Clock in/out with location verification
  • •Track work hours and earnings
  • •Receive payments through agencies

For Agencies

  • •Create and manage staffing agency profiles
  • •Post and manage shift opportunities
  • •Recruit and manage staff members
  • •Track attendance and work hours
  • •Process payroll and payments

5. User Conduct & Responsibilities

5.1 General Conduct

You agree NOT to:

Use the Service for any illegal purpose or in violation of any laws
Impersonate any person or entity or misrepresent your affiliation
Upload false, misleading, or fraudulent information
Harass, abuse, or harm other users
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any part of the Service
Use the Service to send spam or unsolicited communications
Scrape, crawl, or use automated means to access the Service without permission

5.2 Staff Responsibilities

Provide accurate information about your qualifications and experience
Arrive on time for accepted shifts
Clock in and out at the actual work location
Perform assigned duties professionally and responsibly
Comply with all applicable employment laws and regulations
Maintain appropriate professional conduct during shifts

5.3 Agency Responsibilities

Provide accurate shift information including location, time, and compensation
Comply with all applicable employment and labor laws
Process payments to staff accurately and on time
Maintain a safe and professional work environment
Not discriminate against staff based on protected characteristics
Maintain accurate records of shifts and payments

6. Location Services

The Service uses location data to verify attendance and prevent time fraud:

Location is collected only when you clock in or clock out of a shift
Location data is used to verify you are at the designated work location
You must enable location services to clock in/out of shifts
False location data or attempts to spoof your location are prohibited and may result in account termination
Location data is shared with the employing agency for attendance verification

7. Payments & Financial Terms

7.1 Compensation

Compensation rates are determined by individual agencies and communicated through the platform. EventMatch does not set, guarantee, or enforce payment rates. Payment arrangements are between Staff and their employing Agency.

7.2 Payment Processing

Agencies are responsible for processing and distributing payments to Staff
EventMatch facilitates payment tracking but does not process actual payments
Payment disputes should be resolved directly between Staff and Agency
EventMatch is not responsible for late, missed, or incorrect payments

7.3 Taxes

You are solely responsible for all applicable taxes related to your use of the Service. Staff members are typically classified as independent contractors or employees of their Agency, not of EventMatch.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by EventMatch and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8.2 Your Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with providing the Service.

9. Disclaimers

Important Notice

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free
We do not guarantee the accuracy, completeness, or reliability of any content
We are not responsible for the conduct of any user on or off the platform
We do not endorse or verify the qualifications of any Staff or Agency
We are not an employer and do not provide employment benefits

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVENTMATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless EventMatch and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Employment Relationship Disclaimer

EventMatch is NOT an employer. We provide a platform that facilitates connections between Staff and Agencies. Any employment or contractor relationship is solely between Staff and their employing Agency. EventMatch does not:

  • ✕Control how or when Staff perform work
  • ✕Set wages or compensation rates
  • ✕Provide employment benefits
  • ✕Withhold taxes or make tax filings on behalf of Staff
  • ✕Make hiring or firing decisions

13. Dispute Resolution

13.1 Informal Resolution

Before filing a formal dispute, you agree to first contact us at legal@eventmatch.app to attempt to resolve the dispute informally within 30 days.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EventMatch is incorporated, without regard to its conflict of law provisions.

13.3 Arbitration

Any disputes arising from these Terms or your use of the Service that cannot be resolved informally shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

15. Termination

You may terminate your account at any time by contacting us or through account settings
We may suspend or terminate your account at any time for any reason, including violation of these Terms
Upon termination, your right to use the Service will immediately cease
Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnification, and limitations of liability

16. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and EventMatch regarding the Service.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
